Terms of Service

These Terms of Service (“Terms”) govern your use of Forever Story (the “Service”), operated by Forever Story Australia (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

The Forever Story generates personalised, AI-written bedtime stories and reads them aloud with synthesised voices. Stories are created for personal, family entertainment.

2. Eligibility & accounts

You must be at least 18 years old and capable of forming a binding contract to create an account. The Service is intended to be operated by a parent or guardian on behalf of their family. You are responsible for your account, for keeping your login secure, and for all activity under it.

3. Subscriptions, billing & cancellation

• The Service offers a free allowance and paid subscription tiers, billed monthly or annually through our payment processor (Stripe). Prices are shown on the pricing page and are in United States Dollars (USD).
• Paid subscriptions renew automatically until cancelled. You may cancel at any time; access continues until the end of the current billing period.
• Each tier includes a monthly allowance of stories; additional usage may require an upgrade or top-up.
• Except where required by law (including the Australian Consumer Law), fees are non-refundable. We do, however, allow a grace period of 5 days from the time of payment for the user to request a refund if they choose to cancel their service, or, if choosing to downgrade to a different payment tier, we will refund the difference. This refund policy will only be honoured if the customer has not generated stories during that 5 day period, or used AI features of the platform in any capacity.

4. Acceptable use

You agree not to misuse the Service, including not to: submit unlawful, harmful, or infringing content; attempt to generate content that is inappropriate for children; reverse-engineer, scrape, or overload the Service; resell or commercially exploit it without our permission; or use it in breach of any law.

5. Your content & our content

You retain ownership of the inputs you provide (such as names and world prompts). You grant us a licence to process those inputs (including via our AI providers) to generate and deliver your stories. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-commercial licence to use the stories and audio we generate for you, for your family's private enjoyment. The Service itself, including its software, design, and branding, remains our property.

6. AI-generated content

Stories and voices are produced by automated AI systems. While we design the Service to be gentle and age-appropriate, AI output can be unpredictable and we cannot guarantee every story will suit every child. Please review content and use your judgement. Content is provided for entertainment and is not educational, medical, or professional advice.

7. Service availability

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may modify, suspend, or discontinue features from time to time.

8. Consumer guarantees & disclaimers

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other laws that cannot be excluded. Subject to those rights, the Service is provided “as is” and “as available”, and to the extent permitted by law we exclude all other warranties.

9. Limitation of liability

To the maximum extent permitted by law, and subject to the consumer guarantees above, our total liability arising out of or in connection with the Service is limited to the amount you paid us in the previous 12 months / resupplying the service. We are not liable for indirect or consequential loss.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required to protect the Service or other users.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes through the Service or by email; continued use after changes take effect means you accept the updated Terms.
